Ordinance for a separate Chapter for CHS: New Ordinance published on 9th March 2019 to include a new Housing Chapter in Maharashtra Co-operative Societies Act, 1960. The CHS up to 250 members will be able to do the elections internally and the relatives of members may be admitted as Associate member who will be able to contest the election with the consent of original member, penalty of ` 100/- per day maximum up to ` 5000/- will be levied on the office bearers who fail to provide information as provided in the Act, etc.


No nuisance to others by feeding birds or animals–SC: Hon’ble Supreme Court dismissed the SLP No. 23146/2016 (Jigeesha Thakore vs. Dilip Sumanlal Shah & others) upholding the order of Hon’ble High Court and Civil Court. HC had held that one may want to feed birds and animals, the same would obviously have to be done in a manner as not to cause nuisance to the neighbours or other residents. It is well-settled that a person cannot use his premises causing nuisance to his neighbours or other residents.


Society or Association to decide the fate of the registered real estate project: MahaRERA Order No: 7/2019 date: 8th February 2019 provides that if any developer fails to complete the project within the extended period of one year as provided under section 6 of RERA, such developer may be given further extension only after the same is agreed by the Association of Allottees consisting of more than 51% flat owners as its members.


Uniform DCR for MMR: Govt. of Maharashtra has published the notification dated 10th March 2019 to invite the suggestions and objections on a draft comprehensive and integrated Development Control Regulations (DCR) for Municipal Corporation in Mumbai Metropolitan Region within one month of its publication.


No Property Tax for residential flats up to 500 sq. feet in Mumbai: The Government has published an ordinance on 10th March, 2019 to give relief from property tax for the residential flats having area up to 500 sq. feet carpet area.
