Regulation of Retirement Homes in Maharashtra
MahaRERA has issued order directing the promoter to ensure the fulfilment of some minimum physical specifications in their projects before advertising them as “Retirement Home / Senior Home / Equivalent”.
Followings are the requirements
Building Design
-
Lift for the building having more than one floor
-
Internal and external design of building spaces should consider the free movement of wheelchairs.

Door openings (between jambs) should not be less than 900 mm in width
-
Use of sliding window
-
Easy to grip door knobs and lever types handles of large size to be used
-
Ergonomic design of furniture
-
lightweight, sturdy furniture
Green Building Principles
-
There should be maximum (near -total) use of non-polluting and renewable energy sources in retirement homes
-
The norms defined in chapter 10 and 14 oI model building bylaws 2016 should be complied with fully.
Lifts and Ramps
-
All lifts must have audio and visual signage and signalling systems and to accommodate users requiring assistance and using wheelchairs and similar equipment/ mobility tools.

Mandatory ramps to be incorporated into throughout the building to provide for wheelchair access
Staircase
-
width not less than 1500 mm
-
Handrails on both sides of stair flights.

Treads and risers as per the standards of harmonised guidelines
-
No more than L2 treads in a single flight
-
Spiral stairs should be avoided
-
Illuminated / fluorescent / radium strips should be installed on all stairs
-
Specification of lighting and ventilation of staircases as per NBC

Handrails should be extended12 inch at top and bottom of the staircase and ramps. Ends of handrails should be rounded
Corridors
-
No Steps in corridors
-
It is essential to provide handrails along the walls on either side of the corridor, at suitable heights above the floor level.
Kitchen

Design as per NBC

Mandatory ‘gas leak detection systems
Bathroom

provision of grab rails in Wash basins

Toilet paper roll dispensers should be able to withstand heavy loads

outward opening doors to access bathrooms in an emergency
Lightning and Ventilation

Power Back up facilities in each apartment

lighting and ventilation in compliance to MBBL and NBC

Advocate lightings in the common areas including corridors, lobby and lifts to be supplied undisrupted electricity with power backup facility
Safety and Security

Alarm system in the premises, especially with separate switches
-
Emergency alarm and lights controls at bedside and bathrooms near toilet seat.

Appropriate safety measures in all electrical equipment
-
Properly trained and skilled security personnel
-
entry passes for all visitors including service providers to be issued
-
CCTV cameras
-
Emergency fire-fighting services

Emergency and important contact numbers should be provide to all residents and displayed in all common areas i.e. outside lifts.
The above draft order is issued for the feedback of the all stakeholders.
II. Order 50 dated 10.01.2024
Double/ multiple registration of real estate project on the same project land or part thereof not to be permitted / allowed.
Submission by promoters of a Declaration-cum-Undertaking a long with the application for registration of their real estate project.
MahaRERA noticed that promoters apply for registration of their real estate project to be executed on a particular project land even when there is a subsisting pending application submitted for registration of a real estate project by whatever name called to be executed on the very same project land / part thereof or when there already exists a real estate project by whatever name called registered with MahaRERA being executed on the very same project land / part thereof.
Therefore, the order is issued that
a. While applying for registration of a real estate project, promoters shall upload a Declaration-cum-Undertaking on the Letterhead of the promoter in the format prescribed in this order containing the details as follows;

- Details about the application for registration of project

- Address/place of Land or the details of the land where project is situated
-
- Undertaking that on the date of application there is/ are no subsisting pending application submitted to MahaRERA for registration of real estate project(s) by whatever name called to be undertaken on the project land / part thereof or there is / are no real estate project(s) by whatever name called, registered with MahaRERA being executed on the project land / part thereof.

- Undertaking that on the date of application there is / are no subsisting pending application submitted to MahaRERA for registration of real estate project(s) by whatever name called to be undertaken on the project land / part thereof or there is / are no real estate project(s) by whatever name called, registered with MahaRERA being executed on the project land / part thereof and that the plans as approved by the Competent Authority in respect of the real estate project, project name for which the application is submitted for registration does not amend/ modify/ delete/ alter, the common / special amenities such as recreation / playground, parking, internal road(s), club house, gymnasium, swimming pool, play area (list not exhaustive) as the case may be, provided to the real estate projects in the layout already registered / to be registered with MahaRERA as well as the public amenities such as amenity plot, built up amenity, other public reservations (list not exhaustive) as the case may be, as approved by the Competent Authority /Government of Maharashtra.
b. In case of standalone building / buildings for which MahaRERA registration is sought under single project registration number, declaring and undertaking as follows
“that on the date of submission of the application for registration of their real estate project to be undertaken on land bearing CS No(s) ____ / CTS No(s) ____ / Final Plot No(s) ____ / Survey No(s) ____ _, Hissa No(s) ___ _ / Gat No(s) ____ I Khasra No(s) ____ I Plot No(s) ____ lying and being at--- Village ____ _ Taluka --- District _____ admeasuring ___ _ sq. mtrs hereinafter ref erred to as the “project land” there is I are no subsisting pending application submitted for registration of real estate project(s) by whatever name called to be undertaken on the very same project land I part thereof or there is I are no real estate project(s) by whatever name called, registered with MahaRERA being executed on the project land/ part thereof.”
In case of layout development where MahaRERA registration is sought for respective building(s) under different project registration numbers declaring and undertaking as follows;
“that on the date of submission of their application for registration of their real estate project to be undertaken on land bearing CS No(s) _____ / CTS No(s) ____ /Final Plot No(s) I Survey No(s) ____ ___, Hissa No(s) I Gat No(s) _____ / Khasra No(s) _____ / Plot No(s) _____ lying and being at Village Taluka District admeasuring sq. mtrs hereinafter ref erred to as the “project land” there is are no subsisting pending application submitted for registration of real estate project(s) by whatever name called to be undertaken on the very same project land I part thereof or there is I are no real estate project(s) by whatever name called, registered with MahaRERA being executed on the project land/ part thereof and that the plans as approved by the Competent Authority in respect of the real estate project for which the application is submitted for registration does not amend I modify I delete /alter, the common I special amenities such as recreation I playground, parking, internal road(s), club house, gymnasium swimming pool, play area (list not exhaustive) as the case may be provided to the real estate projects in the layout already registered I to be registered with MahaRERA as well as the public amenities such as amenity plot, built up amenity, other public reservation (list not exhaustive) as the case may be as approved by the Competent Authority I Government of Maharashtra”
